YSU LEGAL CLINIC TO GAIN A NEW VICTORY IN COURT
The First Instance Court of General Jurisdiction of Yerevan, by its decision made on 12.12. 2018 in relation to the civil case N ԵԿԴ/0244/02/17 refused the lawsuit of Yerevan community against Ara Vagharshakyan on the demand for confiscation of 872.343.4 AMD.
Citizen Ara Vagharshakyan appealed to YSU Legal Clinic to defend his rights. The 4th year student Zhanna Hakobyan headed by the lecturer of the Legal Clinic and the Chair of Civil Procedure of the Faculty of Law, PhD in Law Tigran Markosyan studied the case, drew up the legal documentation and represented the case in the court.
YSU Legal Clinic started to provide legal support to the defendant in this trial during the period when there was already enforced decision of the First Instance Court on the satisfaction of the lawsuit which was already at the stage of implementation by the Compulsory Enforcement Service.
YSU Legal Clinic drew up and presented the cassation against the decision and the Civil Cassation Court cancelled the decision of the First Instance Court and the case was sent back to be re-investigated. During the new trial in the First Cassation Court, on the initiative of the Legal Clinic, Ara Vagharshakyan presented the petition of expired limitation which served the basis for making a decision in favour of the defendant and fixing another win with the participation of the clinic.
As a counsellor of the clinic Zhanna Hakobyan also drew up various judicial documentation for other citizens appealed to the clinic in the academic year of 2017-2018, represented them at the court to defend their rights for which she was rewarded with a thanksgiving diploma by YSU Rector.
